Terms and Conditions – Scholars Tutorial

These Terms and Conditions govern access to and use of the Scholars Tutorial school assessment platform (the “Platform”). By registering for, subscribing to, or using the Platform, you confirm that you have read, understood and agreed to these terms.

1. The Service

The Platform provides schools with tools to create, deliver, mark and report on assessments, including role-based portals for staff, students, parents and administrators. Scholars Tutorial grants the school a non-exclusive, non-transferable right to use the Platform for its internal educational purposes during the subscription term.

2. Accounts & Access

  • Schools are responsible for creating and managing user accounts and roles.
  • Users must keep their login credentials secure and must not share them.
  • The school is responsible for activity carried out under its accounts.
  • We may suspend access where necessary to protect the security or integrity of the service.

3. Acceptable Use

You agree not to:

  • Use the Platform unlawfully or upload unlawful, infringing or harmful content
  • Attempt to gain unauthorised access to, disrupt or reverse-engineer the Platform
  • Resell, sublicense or make the Platform available to third parties without consent
  • Upload data you do not have the right to process

4. Subscriptions, Fees & Payment

  • Access is provided on a subscription basis; the applicable plan, fees, currency and term are set out in the school's order or agreement.
  • Fees are payable in advance for each subscription period unless otherwise agreed.
  • Where fees remain unpaid past their due date, we may suspend or restrict access until payment is received.
  • Except where required by law, fees paid are non-refundable for the current subscription period.

5. Data & Privacy

The school remains the owner and controller of the data it uploads. Scholars Tutorial processes that data only to provide the service, in accordance with our Privacy Policy. AI-assisted marks, grades and reports are provided to assist staff and should be reviewed before results are released.

6. Intellectual Property

The Platform, its software, report templates, built-in papers and related materials are and remain the property of Scholars Tutorial. Content uploaded by a school remains the property of that school, which grants us a limited licence to host and process it to provide the service.

7. Availability & Support

We aim to keep the Platform available and secure, but do not warrant uninterrupted or error-free operation. Planned maintenance will be communicated where reasonably practicable. Support is provided via the contact details below.

8. Limitation of Liability

To the extent permitted by law, Scholars Tutorial is not liable for decisions taken solely on automatically generated marks or reports, or for indirect or consequential loss, loss of data, or loss of profit. Our total liability is limited to the fees paid for the service in the twelve months preceding the claim.

9. Term & Termination

  • The agreement continues for the subscribed term and renews as agreed.
  • Either party may terminate for material breach that is not remedied within a reasonable period.
  • On termination, access ends and the school's data is deleted or returned as agreed, subject to legal requirements.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified, and continued use of the Platform after changes take effect constitutes acceptance.
